Director
Samantha acts across a broad range of commercial disputes, with particular focus on construction disputes, having acted in complex disputes including adjudications under the Building Industry Fairness (Security of Payment) Act 2017, subcontractor’s charges, and defective works claims among others.
She has advised and represented clients throughout the full lifecycle of a dispute from early contract review through to adjudications, mediations, and contested litigation, frequently appearing in the Magistrates, District and Supreme Courts.
Samantha also has experience acting in non-construction related matters including:

shareholder disputes;

winding up and insolvency related proceedings; and
-
breach of contract and/or misleading and deceptive conduct claims.
Some notable matters include:

acting on a $42 million construction adjudication based in Auckland, New Zealand — one of the most voluminous ever run in New Zealand;

acting in Niclin Constructions Pty Ltd v Yatala Formwork Pty Ltd [2023] QSC 285;
-
various adjudications under the Building Industry Fairness (Security of Payment) Act 2017 and equivalent security of payment legislation, followed by District Court of Queensland proceedings for enforcement of adjudication orders and/or appeals of adjudication decisions; and
-
contract review and drafting for builders, subcontractors and commercial clients seeking to manage risk before disputes arise.
Clients value Samantha’s ability to deliver direct practical advice grounded in delivering commercial outcomes. She understands that litigation is often stressful and works closely with clients to alleviate some of that stress.
Based in Brisbane, and with offices on the Gold Coast, Samantha is able to service clients across South-East Queensland, and Australia.
